| Call Centers abusing Art 286 of the Labor Code | October 5, 2011 @ 11:29pm | I hope you are in perfect health upon reading this email. I am Danilo Engelbert Centeno , from Cavite City and has been a great follower of your career and the President's.
The reason why I emailed you is to seek help in getting the attention of our lawmakers about the provision in the Labor Code , Art 286 the right of Companies to Temporarily retrench any employees. This provision is now being abused by Call Centers in the country to get rid of regular employees and then hire new ones. This practice has been going on for sometime now and has affected several employees and the people the families that depends on them. I my self is a victim of this, I was an Operations Manager of Alorica Phils , I have worked for them for 7 years and when our client moved to another center, instead of transferring me to another project or declaring my position redundant the company opted to put me on floating status for 6 mos. without pay including 30 other regular employees. We have sought the help of upper management including the mother company in the United States but nobody listened. I know there are a lot of procedures that Alorica did not follow before putting us in floating status, like the 30 day notice and establishment report. Our HR head also informed us that we can seek employment but just make ourselves available if recalled by Alorica Phils. Most of us sought employment from another Center because we have no other means of livelihood. When Alorica found out about our employment they informed us either to resign from the company we got connected or resign from Alorica, so what I did was resign from the company I got connected because I value my tenure in Alorica but just before my 6th month of floating status they terminated me for Conflict of Interest. It is very obvious that they just don’t want to pay me for redundancy. This practice is very rampant now in the Call Center industry and they are now the number 1 industry in violating labor laws. I hope I can explain our concern further because there are so much details and things which is hard to describe and write thru email. I hope to get a response from you the soonest time possible.
