UTMOST CONCERN OF BAYANING PILIPINO FROM DUBAIJune 30, 2009 @ 10:41pm

Dear Sir,

I am Benjamin Aldiano from Paranaque City, a new OFW but already has an experienced working abroad specifically GCC countries like Kuwait, Dubai/Abu Dhabi,UAE and Qatar. The last worked I have is in Abu Dhabi, UAE only this year and I just came home last February of this year to wait for my new visa which is employment visa. Because of the recession on going now my previous company closed down and after getting a new employer there I have to go back to our country and with the advice of them. Too much waiting of my new visa, I resorted in finding out new opportunity here in the Philippines thru agency. Fortunately I was lucky enough to be selected by an employer in Dubai after going thru a series of selection criteria. All is well after signing an employment contract with them. The requirements are already submitted and medical exam will be the next step which became my main problem. No problem with all my requirements and agency told me deployment will be before end of June or early July while waiting for the visa and the ticket. I was very happy then and full of hope to fulfill my dreams to save for my future and help my family as well, for I was the only one in the family as being the breadwinner and have 2 dependents- my sick mother and blind aunt. But all this happiness, dreams and aspirations in life and for family shattered and in the brink of losing it if I will not make a move to depend this to my agency and employer. The main reason is my medical exam specifically the controversial "LUNG SCAR" as diagnosed by my agency's accredited clinic thru my X-ray check-up. All my exams are perfectly fit but only on this matter, I was told I'm unfit to continue my job opportunity in UAE. I can't accept the fact that after all my hardships in going thru this opportunity, focusing on this by resigning from local job and spent some money for the requirements, all will be gone in just 1 day. After telling the doctor to consider my
medical certificate and previous X-rays result which was given to me by my personal licensed doctor who supervised my health for the past years, everything came into a deaf ear and always insisting the memo regarding medical requirements from GCC countries now which involves "LUNG SCAR" not allowed in those countries as they are very strict on that, OK i do understand all your positions on this matter including government agencies for OFW's. But try to understand also our situation. Much as my agency and employer wants me to deploy immediately because my position is urgent and they need my services as soon as possible, they cannot do about it because of this memo and law of host country would prevail which i know our country and GCC countries agreement. I'm really depressed about it and until now I'm still fighting for my right by talking to my agency and my employer to give me a consideration and a chance given the fact that I was working before in
UAE and diagnosed there physically and mentally fit, the reason why I granted a residence visa.

The following points I want to point out and reiterate regarding this matter not only for myself but for the others as well who has the same case as mine:

1. The "LUNG SCAR" which is already a scar and healed and it will be in your body for the rest of your life and no medicines or therapy to get rid on this as told by
my doctor and other specialist, unless there's one invention already to get rid this inside of our lungs or the doctor would put their hands inside our lungs and apply
cebo de macho...(just joking). This is not contagious anymore because it's already healed from past history and our personal doctors and specialist would attest on
that. Why put more pressure on this as a selective disease and be controversial, the HEPA, HIV and other contagious disease should be the one to put more
emphasis as being to be more concerned about and not on this healed "LUNG SCAR".


2. Why not government agencies who takes care on OFW's like our consulate there with your permission, agencies like POEA, OWWA, and other consular embassies from GCC countries review this memo
and guidelines about this medical requirements and have some talks with the representatives of GCC countries. Put out utmost concern with the welfare of new
"Bayaning Pilipino" about this plight, just because they have healed "LUNG SCAR", they will be deprived of opportunities working abroad not just for themselves but
for their individual families as well

3. Recession is still here and the fact that opportunity comes only once in your lifetime, this is the right time for us Filipinos to think of our future and become
productive in our life and in our country. As more Filipinos welcome this idea, many would think of employing themselves in abroad for security and financially,
economy in our country would be in a greater heights given this kind of idea as long as the situation like this would come to an end.

With this, I hope our Consulate there in Dubai with you our honorable senate president pro tempore and others would enlighten what I discussed here not only for myself but for the others as well. I hope and pray that my problem with my medical would be over same as with the others and agencies would come out a more specific and fair treatment to this healed "LUNG SCAR" OFW's who only dreamed of a better life for themselves and for their families and be given an opportunity to be accepted and to worked in all GCC countries. I do understand that when you go to Dubai, UAE and have a talked to UAE Labor Minister you have some agreements with some issues regarding the plight of OFW's there but how about us dreaming to come back and work again in UAE will be banned just because of this healed LUNG SCAR which is not a risk anymore and still productive citizen after all. PLEASE HELP ME and others as well with the same situation to revert the memo they issued by talking and do some actions to the representatives of UAE labors and offices who issues visa for the problem is there.
