| Help us from CIDG harrassment | June 7, 2009 @ 9:23am | Im writing this to seek help from people who knew about illegal arrest and illegal detention. Last May 15, 2009 CIDG speacial task force anti illegal recruitment conducted an entrapment operation at my office as a responce to people who file a complain against my company TAYLORS VISA AND TRAVEL CONSULTANCY. It was around 5:30 in the afternoon when these CIDG did the entrapment. What happened was, an old client of ours who had failed the TOEIC test a month ago went back to the ffice to pay for his retake test. It is a policy at the office that in able for us to assist the clients for the documentation of their visa application that he must passed the English exam that is required for him to take otherwise he can get his money back as we cannot assist them or he can have a retake provided that the evaluation has been approved. However, this guy who failed the said test cannot qualify for a retake as he got a very low score. It means that after he will have a retake a chance on failing it again is big so for him not to waste his money he is not allowed for a retake instead he can apply for a refund which we usually offers to those who failed their test. FDue to this, when he went to my secretary and insisted on paying...he was refused to. He went back again to another employee which is the cashier and drop the money P200 on the table for his retake. My cashier picked it up and try to return to him as he is not allowed to take the said retake. As soon as she picked it the CIDG arresting officer announced that we are arrested for ILLEGAL RECRUITMENT. My relative whom I asked to stay at the office as I need to take a leave very soon as Im due to give birth rished at my classroom which Im teaching TOEIC review and cried that they are being arrested for Illegal recruitment. I rushed to the reception area and asked the CIDG arresting officer why we are being arrested? Instead of giving me the details he shouted at me and said we are arrested for ILLEGAL RECRUITNENT. Nagalit ako at sinabi ko bakit kami inaaresto for such crime when in fact before you enter our office a big notice says WE ARE NOT A RECRUITMENT AGENCY he was even insisting that i do not have a POEA LISENCE which I answered him Why would I have that when we are not a recruitment agency nor a manpower agency...we are a consultancy. I as well asked for their WARRANT OF ARREST AND SEARCH WARRANT AS THEY HAVE STARTED GETTING THINGS OUT OF OUR DRAWERS. AGain, he souted and I was told to sit. Thay even took all my students out from the classroom as told to sit next to us. Due to the commotion, my husband who is smoking outside the office entered and asked what is wrong. Oe of the arresting officer was even looking for him before my husband entered the office. I insisted on why they are asking for my husband when in fact my company is a sole prioprietorship. Anyone needs to be questioned should me. Besides during the entrapment my husband wasnt inside he was with our guard marshall smoking. They took all of us, including my students, husband, the gruard, my cashier, my secretary, my relative whom I asked to man the office and my cousin (her husband) who was there to picked her up. At the CIDG office in Camp Crame, I was asking them why we are being arrested and I knew that they must read our rigths and explained why we are being held nor if we need to be questioned. But they just ignored me and went outside with my studets and threatening them to file a complain against us for illegal recruitment. My students refused to do so as they knew we are ot a recruitment agency. My lawyers arrived after 2 hrs, nothing was explained nor no1 explained what will happen aside to the fact that they were telling that my staff and my husband has to stay there as there was no fiscal availabale and I must go home. I rejected to go home as I do not understand why my staff and my husband must stay there but i must go home. They expalined to me that due that im 9 motnhs pregnant i must go home. My lawyer which I trusted assured me that everything will be alright and I must just go home and go to the hospital as I might give birth anytime. From then on, all i got is to raise money to pay for this and that so they would be allowed to go home. It was all lie as I kept on saying that why would I pay for bribe if we are not guilty.
help me please. Enligthen me on the entrapment procedure. How and whe a warrantless arest will be effective. Why everyone was detained when in fact only one person handed the money but still turns negative only proves that the money was droped on the table as it is being refused at all? What can i do with my old lawyers who havent done anything but instead asking me to raise some funds just to pay people inside. My husband is a foreigner, he is not in anway involved in my business and was not even there when the entrapment happened. But why he must be detained? Why i was sent home when I must be the one to be there as I am the owner? Am i sent home to sort the funds? Please help |
